In this paper it is argued that Grotius views on customary law are compatible with the concept of a ‘Grotian Moment’. However, the idea of accelerated customary international law is developed by Van Vollenhoven, who interpreted Grotius in a questionable way. Whereas Grotius qualifies as a thinker in the tradition of natural law, Van Vollenhoven should be seen as an interactionist. This is especially visible in his publications on adat law, in which he visibly belongs to a romantic, Germanist, and (...) rather pluralist tradition of law. The idea of a Grotian Moment also fits better with this starting point than with natural law. For this reason, the ‘Grotian Moment’ should be renamed ‘Van Vollenhoven’s Moment’. It is argued that this legal theoretical position explains some of Van Vollenhoven’s rather peculiar interpretations of Grotius. (shrink)

After the French Revolution, the codification movement led to the introduction of the Dutch Civil Code and the Commercial Code of 1838. These codifications were generally regarded as the bedrock of a dogmatic system in which little space was left for customs and customary law. Mercantile jurists, such as Holtius and Levy, were opponents of the legalistic approach of the new codifications. They tried to separate mercantile law from civil law in order to protect mercantile law from excessive legalistic influences. (...) According to them, mercantile law was characterised by internationality, custom as its main source of law, continuity through an extended mercantile legal history and by good faith and mutual trust between the merchants. Out of these, the historicity and homogeneity of a strong community of merchants are particularly in line with a traditional and conservative view on society. Holtius and Levy, however, had little in common with their Christian-conservative contemporaries. On the one hand, they rather seemed to foreshadow the kind of liberal-conservatism as expressed by Hayek during the 20th century. On the other hand, their ideas have much in common with different lex mercatoria –traditions developed by authors as Goldman and Schmitthoff. On the aspects of historicity and internationality Holtius and Levy seem to have much in common with Hayek whereas concerning communality and the legal nature of customary law there are more similarities with the lex mercatoria-traditions. This book employs contemporary philosophy, scientific research, and clinical reports to argue that pain, though real, is not an appropriate object of scientific generalisations or an appropriate target for medical intervention. Each pain experience is instead complex and idiosyncratic in a way which undermines scientific utility. In addition to contributing novel arguments and developing a novel position on the nature of pain, the book provides an interdisciplinary overview of dominant models of pain. The aim of this paper is to investigate the transition in natural science from the search for the essence of matter to the search for the laws to which matter is subject. Starting about 1600, this transition meant a change of perspective, the introduction of a new metaphysical view of the world. A scientific worldview has at least four components, its ontology, epistemology, logic and heuristic, which I shall discuss with respect to the idea of natural law.

This study investigated the relationships among oppositional defiant attitudes, moral reasoning, moral value evaluation and self-reported delinquent behaviour in adolescents (N = 351, MAGE = 13.8 years, SDAGE = 1.1). Of particular interest were the moderating effects of age, educational environment and gender on the relationship between moral reasoning and delinquency. The results indicate that oppositional defiance was a strong positive correlate of delinquent behaviour, particularly in late adolescence. Furthermore, moral reasoning was modestly and negatively related to delinquency, but only (...) for males. No moderating effects for educational environment were observed. Moreover, moral value evaluation was uncorrelated with delinquent behaviour when controlling for other sociomoral processes. These findings invite further research on the relationship between attitudes and behaviour, with respect to causal links and practical applications within behavioural interventions. (shrink)

Though pain scientists now understand pain to be a complex experience typically composed of sensation, emotion, cognition, and motivational responses, many philosophers maintain that pain is adequately characterized by one privileged aspect of this complexity. Philosophically dominant unitary accounts of pain as a sensation or perception are here evaluated by their ability to explain actual cases—and found wanting. Further, it is argued that no forthcoming unitary characterization of pain is likely to succeed. Instead, I contend that both the motivating intuitions (...) behind unitary accounts and the wide range of pain phenomena are best accommodated by a componential view of pain that does not privilege any single component as necessary or sufficient. Mimesis is a fundamental and pervasive human concept, but has attracted little attention from Johannine scholarship. This is unsurprising, since Johannine ethics, of which mimesis is a part, has only recently become a fruitful area of research. Bennema contends that scholars have not yet identified the centre of Johannine ethics, admittedly due to the fact that mimesis is not immediately evident in the Johannine text because the usual terminology for mimesis is missing. This volume is the first organized study on (...) the concept of mimesis in the Johannine literature. The aim of the study is to establish that mimesis is a genuine Johannine concept, to explain its particulars and to show that mimesis is integral to Johannine ethics. Bennema argues that Johannine mimesis is a cognitive, creative process that shapes the believer's identity and behaviour within the context of the divine family. In this contribution, I focus on three key questions that arise when engaging with Ricœur’s lecture, “Suffering is Not Pain.” The first is the methodological issue concerning the philosopher’s role, particularly in taxonomizing. I will examine mental taxonomy, as well as taxonomy more broadly, before turning to pain and suffering more specifically. I then move to Ricœur’s characterization and contrast of suffering and pain throughout the lecture. Following this, I expand on Ricœur’s definition of suffering as a diminution of the (...) power to act by incorporating my own account of suffering as a significant disruption to agency. I explore how this expanded view can contribute to a deeper investigation of Ricœur’s agentive hypothesis of suffering within each of his three identified “moments” of suffering, thus enhancing our understanding of the specific agentive challenge that suffering represents. People can learn to perform new tasks very quickly by making use of lower‐level skills they have developed when learning previous tasks. Hoekstra, Martens, and Taatgen model this process, showing how a system trained on simple tasks (visual search and two working memory tasks) can then quickly learn to perform the attentional blink task, and it ends up making the same sorts of errors as people do.

This article takes it cue from John Dewey and his views on the interrelationship between democracy and education. The basic premise is that education and democracy are inextricably linked and that in a free society the link is severed only at our peril. Education must be both public and democratic if we wish to preserve our democracy's public spaces. We should resist calls for ‘excellence’ if this means educating only ‘the best’ and excluding those most likely to fail. Proponents of “the affective appeal” :787–812, 2014; Zagzebski in Philos Phenomenol Res 66:104–124, 2003) argue that we can make progress in the longstanding debate about the nature of moral motivation by appealing to the affective dimension of affective episodes such as emotions, which allegedly play either a causal or constitutive role in moral judgements. Specifically, they claim that appealing to affect vindicates a version of Motivational Internalism—roughly, the view that there is a necessary connection between moral judgment and motivation—that is (...) both more empirically respectable and less theoretically controversial than non-affective versions. We here argue that the affective appeal fails: versions of Internalism which appeal to affect are neither more empirically supported, nor clearly less controversial, than versions of Internalism which make no such appeal. Although affect doubtless has an important role to play in explaining moral motivation, we are sceptical that establishing any such role advances the debate. (shrink)

As the use of algorithmic decision‐making becomes more commonplace, so too does the worry that these algorithms are often inscrutable and our use of them is a threat to our agency. Since we do not understand why an inscrutable process recommends one option over another, we lose our ability to judge whether the guidance is appropriate and are vulnerable to being led astray. In response, I claim that a process being inscrutable does not automatically make its guidance inappropriate. This phenomenon (...) is not restricted to algorithms, and there are many social processes which we should conform to but are similarly unable to judge for ourselves. I provide a framework for how we can depend on inscrutable processes by introducing a distinction between knowing conformity (where I understand what justifies the guidance) from mere conformity (where I merely do what I am told) and showing how mere conformity is often positively valuable because it allows for extended processes that in turn allow us to accomplish more than we could on our own. This is in effect a division of deliberative labour, which I argue is something commonplace but not often recognised, of which algorithmic guidance can be an example. (shrink)

Max Weber's concept of the iron cage has become a byword in the scholarly world since the publication in 1930 of Talcott Parsons' translation of The Protestant Ethic and the Spirit of Capitalism . What is less well-known is that Jules Verne had earlier used the iron cage metaphor in Twenty Thousand Leagues Under the Sea (1869) to reveal the paradoxes of modernity. Roland Barthes criticized Verne's vision of modernity as bourgeois and positivistic, pointing out his narrow-minded enthusiasm for futuristic (...) technology. In this essay, I argue that Verne's originality lies precisely in his equivocal attitude towards modernity with its high technology. Verne, I suggest, does not reject technological modernity, but by dissecting it he reveals its propelling forces, high demands and price. He shows that the Enlightenment's Rule of Reason is, in the end, governed by the ancient passions of fear, bitterness and the thirst for revenge. It is this combination that makes the human condition tragic. Verne's Homeric imagination creates an epic hero—Captain Nemo—who personifies the remarkable alliance of modern science and ancient heroism. (shrink)

Background: The classical symptom specificity hypothesis (Blatt, 1974) links obsessional symptoms to autonomous interpersonal behavior. Inconsistent findings from cross-sectional group studies on symptom specificity have previously been associated with several conceptual and methodological limitations intrinsic to nomothetic research. Previous empirical case research reported ambivalences between autonomous and dependent interpersonal behavior in obsessional pathology. Aim and Method: The present ‘theory-building’ case study specifically aims at further refinement of the classical symptom specificity hypothesis by testing specific operationalizations within an empirical single case (...) design. Consensual Qualitative Research for Case studies is used to quantitatively and qualitatively describe the longitudinal, clinical interplay between obsessional symptoms and interpersonal dynamics throughout the process of a psychodynamic therapy. Interpersonal functioning is assessed by means of the Core Conflictual Relationship Theme method. The classical symptom specificity hypothesis is contrasted to an alternative hypothesis of interpersonal ambivalences as determinants of obsessional symptoms. Results: Close associations between obsessions and interpersonal dynamics are observed. Findings predominantly affirm the ambivalence hypothesis rather than the classical symptom specificity hypothesis. Psychodynamic interventions focusing on interpersonal conflicts are related to symptomatic changes. Conceptual and methodological considerations, limitations and future research indications are discussed. (shrink)

Traditional eliminativism is the view that a term should be eliminated from everyday speech due to failures of reference. Following Edouard Machery, we may distinguish this traditional eliminativism about a kind and its term from a scientific eliminativism according to which a term should be eliminated from scientific discourse due to a lack of referential utility. The distinction matters if any terms are rightly retained for daily life despite being rightly eliminated from scientific inquiry. In this article, I argue that (...) while scientific eliminativism for pain may be plausible, traditional eliminativism for pain is not. I discuss the pain eliminativisms offered by Daniel Dennett and Valerie Hardcastle and argue that both theorists, at best, provide support for scientific eliminativism for pain, but leave the folk-psychological notion of pain unscathed. One might, however, think that scientific eliminativism itself entails traditional eliminativism—for pain and any other kind and corresponding term. I argue that this is not the case. To adequately model mathematical arguments the analyst must be able to represent the mathematical objects under discussion and the relationships between them, as well as inferences drawn about these objects and relationships as the discourse unfolds. We introduce a framework with these properties, which has been used to analyse mathematical dialogues and expository texts. The framework can recover salient elements of discourse at, and within, the sentence level, as well as the way mathematical content connects to form larger argumentative structures. (...) This article offers a new theory of suffering as significantly disrupted agency. In presenting it, I here make three significant contributions. First, I subject the leading account of suffering as undesired unpleasant experience (Brady, 2018) to its first dose of sustained scrutiny. Second and drawing on this discussion, I identify and liberate eight desiderata for any account of suffering. Third, I present the novel account of suffering as significantly disrupted agency and argue that it satisfies these desiderata. Moreover, I argue (...) that elaborating this proposal with a minimal model of agency allows us to capture both the suffering of a wide range of organisms and the complex dynamics of suffering as it is endured. I conclude by briefly highlighting some of the potential implications of the theory for further theoretical and practical inquiries. (shrink)

Painful pains are, paradigmatically, unpleasant and motivating. The dominant view amongst philosophers and pain scientists is that these two features are essentially related and sufficient for painfulness. In this article, I first offer scientifically informed characterizations of both unpleasantness and motivational oomph and argue against other extant accounts. I then draw on folk-characterized cases and current neurobiological and neurobehavioral evidence to argue that both dominant positions are mistaken. Unpleasantness and motivational oomph doubly dissociate and, even taken together, are insufficient for (...) painfulness. (shrink)

Nietzsche's ethics is basically an ethics of virtue. In his own unique way, and in accordance with his extra-moral view of life, Nietzsche recovers and re-appropriates certain virtues – notably pagan, aristocratic virtues – as part of his project to reconceptualise (‘rehabilitate') the virtues in terms of virtù (virtuosity and vitality), to which he also refers as his ‘moraline-free' conception of the virtues. The virtue of generosity (in the sense of magnanimity) plays a central role in Nietzschean ethics. According to (...) Nietzsche, the truly noble or virtuous person is one who lives beyond resentment and feelings of remorse and guilt. He lives his life from the fullness and plenitude of his own being and what he is able to bestow on others. Nietzsche seeks to rekindle and rehabilitate the aristocratic ‘pathos of distance' as the true origin of ethical life. This pathos of distance basically emanates from self-respect: ‘The noble soul has reverence for itself' (1974b: §287). For Nietzsche, this means that one should realize the greatest multiplicity of drives and form-giving forces in oneself, in the most tension-fraught but ‘controlled' manner. This control, this imposing a form on oneself without neglecting the multiplicity in oneself, is a creative, artistic activity. Nietzsche also refers to this as a process of transforming the self into a work of art, of giving style to one's own existence. Thus we free ourselves from guilt, resentment and the rage against contingency. It is of the utmost importance for Nietzsche that one should attain satisfaction with oneself, for ‘only then is a human being at all tolerable to behold. Whoever is dissatisfied with himself is continually ready for revenge, and we others will be his victims, if only by having to endure his ugly sight.' (1974a: §290). To attain satisfaction with oneself ultimately means to affirm life in its totality. This implies a life beyond resentment, i.e. a life that is characterised by generosity or magnanimity ( megalopsychia, magnanimitas ), which is for Nietzsche the ‘crown' of all the virtues. The aim of this article is to provide a discussion of scholarly ‘crisis of modernity’ discourses that have developed in the field of social philosophy. Re-visiting past and present discourses can be illuminating in at least three ways: it can reveal the broader picture of the present financialized and technologized world and the rise of financial technologies; it can provide scholars with new vocabularies, concepts, and metaphors to comprehend present-day phenomena and developments; and it can reveal the variety of commitments (...) that are possible, today, too. This article starts with a discussion of the original ‘crisis of modernity’ discourses, in which the clashing arguments of Comte and Tocqueville are featured, and a discussion of a second ‘crisis of modernity’ that developed in the context of the ‘Great Depression.’ A third ‘crisis of modernity’ discourse emerged in the wake of the financial crises of the 1970s. Such crises are still ongoing and discussed within the boundaries of the third ‘crisis of modernity’ discourse. How financial technologies do and do not fit within this third discourse is discussed in the remainder of this article. (shrink)

We argue that an understanding of livestock farming as normative practice clarifies how sustainability is to be understood in livestock farming. The sustainability of livestock farming is first approached by investigating its identity. We argue that the economic aspect qualifies and the formative aspect founds the livestock farming practice. Observing the normativity related to these aspects will be the first task for the livestock farmer. In addition, we can distinguish conditioning norms applicable to the livestock farming practice which should be (...) observed for competent performance of the practice. Failing to do justice to this normativity might affect the practice’s sustainability only in the long term—this is especially the case with conditioning norms. Motives to observe normativity have, therefore, the character of an ultimate conviction regarding the flourishing of the practice. Finally, the sustainability of the livestock farming practice crucially depends on the broader food system of which it is part. (shrink)

Te VeldeIn this essay, I want to share my impressions of the first chapter of the dogmatic constitution Dei Filius of Vatican I. It begins its declaration of the basic truths of Christian faith in a language which is similar, and probably intended to be similar, to that of a solemn confession of faith: "The holy, catholic, apostolic, and Roman church (...) believes and acknowledges that there is one true living God, creator and lord of heaven and earth."1 It reminds one, in some of its formulations, of the Nicene Creed, but with a remarkable difference: here, in the text of the constitution, the object of the confession is formulated as a proposition about God's existence.2 What is said is not, for example, "I believe in one God, the Father almighty"; but the Church believes and holds it to be true that there exists a God. One can notice a subtle shift from a confession of faith to the proclamation of a (rational) truth. The Pope, gathered with all the bishops of the Church, declares that there exists a God, the one and true living God, a doctrinal statement directed, by implication, against those who dare to deny the existence of God. The opening sentence of chapter 1 corresponds with its canon, which says that, "if anyone denies the one true God, creator and [End Page 823] lord of things visible and invisible: let him be anathema."3 Thus the constitution says that the "one, true living God" of the biblical faith exists, that this is a truth, and that, as consequence, the opposed thesis of atheism is false and must be rejected.Who is asserting this truth? Who is speaking and with which authority? The text leaves no doubt about the speaking subject. It is the Church, entitled to speak with authority about matters of faith, because it is the Roman Church, holy, catholic, and apostolic. The Church speaks, in the person of the pope, the legitimate successor of St. Peter, with authority granted to her by God himself through his Son Jesus Christ. In the preface preceding chapter 1 of the constitution, it is said that the Church is appointed by God to be "mother and mistress of nations." Hence:She can never cease from witnessing to the truth of God... and from declaring it, for she knows that these words were directed to her: "My spirit which is upon you, and my words I have put in your mouth, shall not depart out of your mouth from this time forth and for evermore"(Is 59:21).4This gives the pope, sitting in the chair of Peter, the authority of "teaching and defending Catholic truth and condemning erroneous doctrines."5 And the first thing to be declared, as part of the Church's task to proclaim the Catholic truth to all the nations, is to assert the existence of God against the error of atheism.It is important to understand the genre of a dogmatic constitution. It is a document in which the Church, by mouth of the pope together with the bishops, expounds the basic tenets of Christian teaching. The purpose of a dogmatic constitution is to reaffirm the basic truths of Christian doctrine, to clarify the fundamentals of faith in a message to the world. A constitution may be occasioned by actual developments in the world and society, but it speaks as it were from the standpoint of eternity. In case of the constitution Dei Filius, the addressee is the world of the mid-nineteenth century, a time of dominance of scientific reason, of materialism, naturalism, atheism, and not unimportantly, of current forms of idealistic pantheism (Georg Hegel, Friedrich Schelling, the influence of German Idealism in general); what the constitution especially stands opposed to [End Page 824] is the view of supernatural religion as being irrational. Scientists, sociologists and philosophers were asked to write on this intriguing problem and to display their results at the International Congress `Einstein Meets Magritte'.
